Plain rules for a trusted marketplace.
These terms set out what you can expect from ActiveHustler and what we expect from you. They apply to customers, hustlers, and visitors in Nigeria. Please read them.
1. About ActiveHustler
ActiveHustler is a trust-first marketplace that helps customers find, verify, request, track, and review skilled hustlers -- across trades, beauty, creative, culinary, and digital work. The platform is operated by ActiveHustler, operated by stayguided.tech.
ActiveHustler is a platform, not a party. We connect customers and hustlers and provide discovery, verification, trust, and dispute infrastructure. We are not party to the agreement between a customer and a hustler, we do not perform the services, and we do not employ hustlers. Where these terms use the words "service" or "services" we mean the platform; the actual professional work commissioned by a customer is provided by the hustler under a separate agreement between them.
In these terms, "customer" means a person or business looking for work to be done, "hustler" means a skilled worker or professional offering work through ActiveHustler, and "content" means profiles, listings, messages, images, portfolio items, reviews, documents, and any other material submitted through the platform. "Fraudulent activity" includes scams, misrepresentation, identity theft, payment diversion, fake listings, false reviews, chargeback abuse, or any dishonest or unlawful conduct.
2. Acceptance of these terms
By creating an account or using ActiveHustler you agree to these terms, our Privacy Notice, and our Ranking & Trust Score Disclosure. If you do not agree, please do not use the platform.
3. Eligibility
- You must be at least 18 years of age and have legal capacity to enter into a binding contract under Nigerian law.
- You must provide accurate registration information and keep it current.
- We may require identity verification, business verification, phone or email confirmation, guarantor checks, or additional documentation before granting or continuing access to some features.
- You are responsible for the security of your credentials and for activity under your account.
4. Your account
- One account per person. Do not impersonate, share, or trade accounts.
- Do not create an account using a false identity, misleading business details, or information you are not authorised to use.
- Keep your password and OTP codes private. Notify us at security@activehustler.com if you suspect compromise.
- If account information is false, incomplete, misleading, unsafe, or cannot be verified, we may restrict, suspend, or terminate the account or related listings.
- You may delete your account at any time. Some content (past reviews, audit logs, financial records) may be anonymised rather than fully erased to preserve marketplace integrity and to satisfy legal retention rules -- see our Privacy Notice.
5. Acceptable use
You may not use ActiveHustler to:
- break Nigerian law or solicit illegal services;
- impersonate another person, business, or organisation;
- upload identity documents that are not yours, or submit verification artifacts you are not authorised to use (this may also constitute an offence under section 22 of the Cybercrimes Act);
- post hateful, harassing, sexually explicit, violent, or deceptive content;
- engage in phishing, identity theft, payment diversion, refund abuse, chargeback abuse, off-platform scam attempts, or any scheme intended to deceive, exploit, or defraud another user or the platform;
- scrape, copy, or republish other people's profiles, reviews, or portfolios without consent;
- circumvent rate limits, security controls, the completion-PIN workflow, or any moderation outcome;
- solicit or pay for fake reviews, fake jobs, or fake verifications;
- misuse another user's phone number, email address, home address, identity documents, financial information, or other personal data for harassment, marketing, impersonation, or fraud;
- request or send payments through suspicious, unauthorised, or untraceable channels where ActiveHustler has directed otherwise;
- advertise prohibited, illegal, unsafe, counterfeit, or non-existent products or services;
- use the platform for money laundering, terrorist financing, or any conduct prohibited by the Money Laundering (Prevention and Prohibition) Act 2022 or related law.
We may suspend or terminate accounts that break these rules. Serious misuse may be reported to the Nigeria Police Force, the EFCC, the NDPC, or another competent authority.
6. Customer responsibilities
- Use ActiveHustler in good faith to commission real work.
- Provide accurate job requests, product requirements, delivery instructions, locations, and payment information.
- Treat hustlers professionally and lawfully. Do not discriminate on any protected ground.
- Do not obtain work by false pretence, make false non-delivery claims, abuse refund systems, reverse legitimate charges in bad faith, harass hustlers, or exploit skilled workers.
- Share your completion PIN with the hustler only after the work is genuinely done. The PIN is your confirmation that the agreed service was performed.
- Leave a review only after a PIN-confirmed job. Reviews must be honest, your own, and based on the service you actually received.
- Pay agreed amounts directly to the hustler unless a payment is processed through the platform. Resolve payment disagreements through good-faith discussion first, then via section 17 below.
7. Hustler responsibilities
- Provide services that match your published profile and the customer's accepted quote, on the agreed timeline, in compliance with Nigerian law and safety practice.
- Keep your profile, qualifications, samples, certifications, prices, delivery timelines, and service descriptions truthful and not misleading. Do not list categories you cannot serve. Do not post portfolio work that is not yours.
- Submit only authentic identity, business, guild, and guarantor records. Submitting false NIN, CAC, or guarantor data may be reported to NIMC, CAC, the Cybercrimes Advisory Council, or the Police.
- Do not use bait-and-switch practices, fake urgency, hidden charges, pressure tactics, or misleading claims about availability, skill, experience, or pricing.
- Do not solicit, coordinate, or accept payment to leave or remove reviews.
- Independent contractor status. You are an independent service provider. Nothing in these terms creates an employment, partnership, joint venture, or agency relationship between you and ActiveHustler. You are responsible for your own personal income tax, business income tax, levies, and regulatory permits where applicable.
8. The verified job lifecycle
To protect both sides, every job follows this flow:
- The customer posts a service request.
- Matched hustlers respond; the customer accepts one (the "accepted hustler").
- The job moves to in progress.
- When complete, the customer issues a four-digit completion PIN to the accepted hustler.
- The hustler enters the PIN to close the job. Only then can the customer leave a verified review.
Reviews on ActiveHustler are tied to PIN-confirmed work. We do not delete a verified review on request; we may moderate or redact reviews that violate these terms.
9. Reports, disputes, and moderation
- You may report a hustler, customer, profile, or review.
- Disputes (no-show, poor quality, unsafe behaviour, price dispute, damaged property, other) go to an admin queue. We may pause a profile while we investigate.
- We may request messages, receipts, screenshots, proof of delivery, identity records, photos, call logs, location evidence, or other relevant information to investigate a complaint or suspected fraud.
- Outcomes can include: warning, score penalty, content redaction, profile suspension, permanent termination, cancellation of platform benefits, temporary payout restrictions where permitted, or referral to law enforcement or a regulator.
- You can appeal a moderation outcome by replying to the decision email or writing to support@activehustler.com.
10. Reviews policy
- Only verified, PIN-confirmed customers can post a review.
- Reviews must reflect a genuine experience and contain no defamation, hate, private personal data of third parties, or commercial solicitation.
- We may redact specific content (for example, NIN numbers or phone numbers posted in error) without removing the underlying rating.
- We do not edit your words. We may take down reviews that breach this policy and notify the author.
11. Payments
- Customers use ActiveHustler free of charge.
- Hustlers may purchase a Pro subscription period for greater visibility, analytics, and priority leads. Paid periods are billed in Nigerian Naira through Paystack or manually activated by an authorized ActiveHustler admin. They do not auto-renew unless ActiveHustler later enables recurring billing and shows that renewal term before payment.
- Verification or lead fees are not charged unless a specific fee is shown clearly before payment.
- Transaction safety: where ActiveHustler facilitates or supports payments, we may place temporary holds, delays, restrictions, reversals, or additional checks on transactions where fraud, unauthorised activity, chargebacks, policy violations, suspicious behaviour, or legal compliance concerns are reasonably suspected.
- Taxes: platform fees and subscription prices are shown inclusive of applicable Nigerian taxes unless explicitly stated otherwise. An invoice can be requested at billing@activehustler.com.
- Refunds (FCCPA compliance):
- You may cancel a Pro subscription at any time. We refund unused subscription days on a pro-rata basis within 14 working days where the refund is for a service failure attributable to ActiveHustler (for example, an extended platform outage).
- Verification fees that have been forwarded to third-party providers (NIMC, CAC) are non-refundable once the check is initiated, because the cost has been incurred.
- Your statutory consumer rights under the FCCPA -- including the right to safe and quality service, the right to information, and the right to redress -- are not waived by these terms.
- No escrow at this time. ActiveHustler does not hold customer payments for jobs. Payments are settled directly between the customer and the hustler. If we introduce escrow or in-platform payments in future, we will update these terms and give notice before the change takes effect.
12. App-store terms
If you obtained the ActiveHustler app from the Apple App Store, the Google Play Store, or another distribution platform, that platform's developer-agreement and EULA terms also apply to your use of the app and in-app purchases. In the event of a conflict between those store terms and these terms for matters specific to the store's distribution and billing, the store's terms prevail.
13. Anti-money-laundering and cybercrime
ActiveHustler complies with the Money Laundering (Prevention and Prohibition) Act 2022 and the Cybercrimes (Prohibition, Prevention, etc.) Act 2015 (as amended 2024). We reserve the right to suspend or terminate accounts engaged in laundering, terrorist financing, payment fraud, identity theft, impersonation, hacking, or interference with the platform's systems, and to report such conduct to the EFCC, the Nigeria Police Force, the NDPC, or another competent authority.
14. Content and intellectual property
- You retain ownership of your content -- profile bio, portfolio, reviews, request text.
- You grant ActiveHustler a worldwide, non-exclusive, royalty-free licence to host, display, and adapt that content for the purpose of operating, securing, and promoting the platform. This licence ends when you delete the content, subject to the redaction rules in our Privacy Notice.
- The ActiveHustler name, marks, logo, and platform code are our intellectual property. They may not be copied, framed, or used to imply endorsement.
15. No warranty; limitation of liability
ActiveHustler provides the platform "as is" and "as available." We work hard to verify identities, score behaviour, and moderate the marketplace, but we do not warrant the conduct of any individual customer or hustler, the quality of work performed off-platform, or uninterrupted availability of the platform.
Subject to the FCCPA and other applicable mandatory law, to the maximum extent permitted, ActiveHustler is not liable for indirect, incidental, special, or consequential losses arising from your use of the platform. Our total aggregate liability in any matter is limited to the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) ₦100,000. Nothing in these terms limits liability for fraud, wilful misconduct, or for any liability which cannot be excluded under Nigerian law.
16. Indemnity
You agree to indemnify and hold ActiveHustler harmless from claims, losses, and expenses arising out of (a) your breach of these terms, (b) your violation of any law, or (c) any work you carry out for, or commission from, another user.
17. Governing law and dispute resolution
These terms are governed by the laws of the Federal Republic of Nigeria. The parties shall first attempt to resolve disputes informally by writing to support@activehustler.com. If a dispute cannot be resolved within 30 days, either party may refer it to mediation under the rules of the Imo State Multi-Door Courthouse before commencing litigation. Subject to the foregoing, the High Court of Imo State, Owerri Judicial Division, has non-exclusive jurisdiction, without prejudice to a consumer's statutory right of access to the FCCPC.
18. Consumer protection (FCCPA non-waiver)
Nothing in these terms limits or removes a consumer's statutory rights under the FCCPA. In particular, you retain the right to clear pre-purchase information, the right to safe and quality service, the right to redress, and the right to bring a complaint before the Federal Competition and Consumer Protection Commission (FCCPC) at fccpc.gov.ng.
19. Termination
- You can stop using ActiveHustler at any time and request account deletion.
- We can suspend or terminate access for breach of these terms, suspected fraud, safety risk, or legal obligation. Where reasonably possible we give prior notice.
- We may preserve records and cooperate with lawful investigations after suspension or termination where needed for fraud prevention, dispute handling, safety, tax, accounting, or legal compliance.
- Suspension or termination does not remove obligations that arose before the enforcement action.
- Sections that should survive termination -- disclaimers, liability limits, IP licences, governing law, consumer-protection non-waiver -- survive.
20. Severability and entire agreement
If any provision of these terms is held unenforceable, the remaining provisions remain in full force. These terms, together with the Privacy Notice and the Ranking & Trust Score Disclosure, constitute the entire agreement between you and ActiveHustler.
21. Changes to these terms
We may update these terms. Material changes will be notified to registered users at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
